    In 1965 the US Congress passed and President Johnson signed the Social Security Amendments of 1965 that gave us Medicare and Medicaid. The passage of the Social Security Amendments, popularly known as Medicare and Medicaid, resulted in one basic program of health insurance for persons aged 65 and older, and another program providing health insurance for people with limited income funded by state and federal sources, respectively. It was funded by a tax on the earnings of employees, matched by contributions by employers, and was well received. In the first three years of the program, nearly 20 million beneficiaries enrolled in it.
    In 2009 President Obama successfully negotiated the passage of the Patient Protection and Affordable Care Act. Joe Biden famously whispered into his ear: “This is a big [expletive] deal.” President Obama had to make to pass the ACA
    And then we had COVID and everything changed – more people lost their jobs and their insurance and so many were sick and needed health care including many long hospitalizations. The American Rescue Plan passed in 2021 expanded the ACA but costs were high.
    So the question is what is good and bad about these policies that are the major framework of the US health system? What should we change and why? Or are you satisfied and if so tell us what you think works in Medicare, Medicaid, or the ACA?

    This guide is intended only as a brief and simplistic introduction to legal research and as such give only a general overview using only a few of the more common and readily available legal reference materials.
    INTRODUCTION
    Please be aware that most cases involving medical negligence or malpractice never go to court, but are settled out of court. Court cases settled at the local court level are not published, only cases that ae appealed to a higher court are published. Cases may be appealed to State courts and to Federal District courts and all the way to the Supreme Court. The Supreme Court only rules on questions of constitutionality, any other legal ruling is referred back to a lower court.
    Another thing that any student doing legal research should know is the difference between the three forms of law.
    STATUTORY LAW
    Statutory law can be defined as the original laws enacted by a body legally authorized to pass laws, such as the Congresses of the United States or the State of Louisiana. When signed by the President or the Governor, they become law and are eventually incorporated into the United States Code (U.S.C.) or the Louisiana Constitution.
    ADMINISTRATIVE LAW
    Administrative law, also referred to as quasi-statutory law, refers to the rules and regulations which are written by agencies. These agencies are given the authority by Congress to write and enforce these rules. The Federal Register and the Louisiana Register are the mediums for notifying the public of rules and proposed rules for all Federal and Louisiana State agencies and departments. After publication in the Register as a final rule, the regulations are incorporated into the Code of Federal Regulations (CFR) or Louisiana Administrative Code.
    CASE LAW
    Case law refers to cases decided in courts of law, at appellate courts on the federal or state level, or, at the highest level, at the U.S. Supreme Court. These cases are adjudicated based on the court’s interpretation of statutory laws and the precedence of previous court decisions. Supreme Court cases are found in United States Reports and cases from Louisiana appellate courts are found in Southern Reporter 3d series (West).
    ETHICS
    Although not laws, many professional associations have codes of ethics by which their member agree to abide. Failure to abide by the ethics may cause a person to be removed from the association and occasionally to be barred from practicing in that profession.
    LEGAL ABBREVIATIONS
    Another thing to be aware of is legal abbreviations. Most legal abbreviations are standard in form regardless of the legal resource used. If unsure of the abbreviation, use Bieber’s Dictionary of Legal Abbreviations. Understanding Case Citations

    WARNING: Every site is different. State and Federal court internet sites may or may not have case information on those sites. Likewise, not all states have regulatory information available on their government internet sites. Even sites that give court cases may not give the complete case but only the opinions of the court or a summary of the case. Not all court or regulatory sites have search engines that allow for keyword searching of the text of cases or regulations.
    Final Project:
    For your final project, each student will write a brief (1-2 page) summary for each of three legal cases using below as a resource. Cases may be located through print or internet searches. The cases can be related to any legal issue affecting healthcare administration, education or clinical practice.
    For each case, students must also submit copies of the “labeled” original cases. On the case indicate the citation, Case Name, Docket #, Date of Decision, Lawyer, Judges, Topic, Relief Sought, Issue, Facts, Holding, Reason, and Decision of the Court.

    Case Presentation Format
    Students are encouraged to locate a recent case and discuss it in the following format:

    2. Topic. What is the main topic of the case.
    3. Relief Sought. What is the plantiff asking?

    5. Facts. A review of the details of the case.
    6. Holding. The court’s ruling based on the facts, issues, and applicable laws pertaining to the case.
    7. Reason. The rationale behind how the court arrived at its decision based on the facts, issues, and relevant laws surrounding the case.
    8. Significance. Discuss the significance of the ruling of the court.
